El error más común al interpretar la tributación de juego actual es pensar que las pérdidas derivadas del mismo pueden compensarse con ganancias patrimoniales que no tienen nada que ver con el ámbito del juego, pero nada más lejos de la realidad.

El objetivo de este artículo es explicar de forma sencilla, especialmente a lectores que no están familiarizados con juegos como el poker, por qué permitir compensar pérdidas derivadas del juego con las ganancias en el mismo, no sólo es lógico sino que es la única manera de que la tributación sea acorde con el principio de capacidad económica y no incurra en la confiscatoriedad para el individuo.

Según la Ley del Juego, un jugador obtiene un premio cada vez que gana una tirada en la ruleta, una jugada en el blackjack o, en el caso que nos atañe, una mano de poker. Estos premios están sujetos a tributación como ganancias patrimoniales, por lo que deben incluirse en la declaración de la renta.

Para entender por qué sería impracticable en términos fiscales que no se pudieran compensar las pérdidas en el juego con las ganancias en el mismo, veamos un sencillo ejemplo práctico.

Una persona juega a 500 manos de poker apostando 100 euros en cada una de ellas a lo largo de un año.

Supongamos que este jugador resulta ganador un 47% de las veces y perdedor el 53% restante. Posterior las 500 manos, esta persona ha ganado en 235 manos la cuantía de 100 euros y perdido 100 euros en las 265 manos restantes.

Todos contribuirán al sostenimiento de los gastos públicos de acuerdo con su capacidad económica mediante un sistema tributario justo inspirado en los principios de igualdad y progresividad que, en ningún caso, tendrá alcance confiscatorio.

Como conclusión, para el cálculo de las ganancias en el juego y su consiguiente inclusión en la declaración del IRPF, se podrán compensar ganancias y pérdidas en el juego, pero en ningún caso, y tal y como se recoge en la propia ley, se computarán en la declaración las pérdidas derivadas de la participación en los juegos.

Las ganancias netas deberán tributar, y las pérdidas netas no podrán considerarse como pérdidas patrimoniales.

Excelente noticia la que nos trae el cierre del seguimiento del día 1C del UKIPT Nottingham en el blog de PokerStars. Un español, Benjamín García “Janfryed”, es el que ha metido más puntos en la bolsa, más que cualquiera de los 265 jugadores que se apuntaron a esta última jornada inaugural o que los 114 que pasaron de día con él.

Si has venido siguiendo estas crónicas desde el Reino Unido, ya te habrás dado cuenta de que los números no le han cuadrado a la constitución. Benjamín está en una posición envidiable para llevarse una buena parte de las 500.000 libras garantizadas, incluido el overlay que ha supuesto la venta de menos entradas de 1.100 libras de las que se esperaban.

A punto de terminar el nivel 6, de los ocho que se jugaban hoy, Benjamín estaba un poquito por encima de la media del torneo, con 31.000 puntos.

Se dobló con trucha de dieces en un board AT8, que se completó con dos cuatros en turn y river, lo que le permitió sacarle el stack al full menor de su rival, A4. 

Con la entrada en la nueva hora de juego se puso en 80.000 y ya no volvió a retroceder, poniendo la guinda a falta de un cuarto de hora con un all-in preflop en el que tenía dominado a su rival.

 Sergio Aido  dio una impresión llevaba el mismo camino, aunque empezaba la remontada un poquito más tarde. Defendió la ciega pequeña con 22 recién empezado el octavo nivel y flopeó un precioso poker que dio buena cuenta del color ligado en el turn por su rival.

Con este bote alcanzaba el punto máximo de su gráfica del día, 66.000 puntos, que sus compañeros de mesa se fueron comiendo en lo poco que quedaba para terminar.

Un estirón en el nuevo momento le permitió sacar la cabeza de nuevo por encima de la media y cerrar con un stack aún muy manejable.

El tercer español que llegaba en la media a los dos últimos niveles era Pablo Rojas “Pableras”. Al andaluz no le faltaron ladrillos para sus castillos de fichas durante la jornada, pero las últimas dos horas se torcieron irremediablemente.

Con una explosión tan tardía y la cuantía de jugadores conocidos que se juntaron en la sala Dusk Till Dawn, nuestros compañeros no hicieron mucho caso de los españoles. Repartidos por el salón de juego se sentaban Jake Cody, Vicky Coren, Chris Brammer, John Eames, David Vamplew, Max Heinzelmann, Dermot Blain y los Team Pro Online de PokerStars Mickey Petersen y Dale Philip.

Martins Adeniya no llegó a cruzar el ecuador del día, y Vamplew le siguió en el camino al raíl poco después.

En los primeros niveles no hubo casi eliminados, porque los stacks eran muy profundos, pero la entrada en juego de los antes y la mesa corta animaron mucho más parte dos de la tarde. Por cierto, Benjamín estaba encantado con el formato.

 Dale Philip  era de los primeros en sentir el aumento de ritmo en carne propia y aunque Cody evitó un primer zarpazo entruchando en el river sus cincos contra unos nueves, solo le valió para seguir jugando shortstack hasta 15 minutos antes del final, momento en el que tuvo que abandonar el torneo..

Benjamín no será chipleader tras la reunificación de los clasificados en los tres primeros días pero tiene todas las papeletas de para ser de los que lleven la voz cantante en la burbuja, situada entre el puesto 71º y 72º.

El Toro fue uno de los 132 jugadores que se registraron hoy, un número un poquito más acorde a la categoría del torneo, y cayó en el nivel 7.

La decepcionante cifra de participantes del día 1A en el UKIPT Nottingham organizado por PokerStars en la mítica sala Dusk Till Dawn se dobló para el día 1B, y aún así lo más probable es que no se cubran las 500.000 libras del garantizado.

Fueron 132 jugadores los que ocuparon la silla que reservaron previo pago de 1.100 libras, entre los que hubo al menos un español, Raúl Páez.

El catalán contó con una buena compañía para olvidar la pena de su eliminación en el séptimo nivel del día, pues Sergio Aido y Pablo Rojas también están en la patria de Robin Hood para intentar llevarse el triunfo. Para pasar el mal trago, nada mejor que una visita de cortesía a los pubs locales.

Páez no fue el primero en saltar al césped en Nottingham, ya que Sergio Aido jugó el High Roller el pasado miércoles sin demasiada suerte. Poco más ha podido hacer Sergio en el Dusk Till Down porque la mesa más alta en el cash es de NL200. El torneo para los bolsillos más repletos del festival se cerró con el triunfo de Jonathan Spinks, por delante de Chris Brammer y Mickey Petersen "mement mori".

Raúl dispuso de 20.000 puntos para defender su presencia en el torneo, que se juega en mesas corta. Entre los rivales dispuestos a llevarse sus fichas se pudo ver a Vicky Coren, J.P. Kelly, David Ulliott, Dominik Nitsche, Chris Brammer o Ludovic Geilich. Posterior los ocho niveles de rigor que hay que cumplir anterior la reunificación de mañana sábado para el día 2, sobrevivieron un total de 54 jugadores.

Para jugar este torneo hay que ir bien desayunado, porque no hay descanso para la comida. El que más energía desplegó en el fieltro fue David Price, que terminó primero con 156.600 puntos.

La mano que le colocó en lo más alto fue un 4bet all-in con reyes contra jotas que le permitió adelantar al lituano Viktor Leonov y a su compatriota Jack Ellwood.
